What it actually requires

Thirteen principles. Four practical groups.

The thirteen Australian Privacy Principles do not all feel the same in practice. The four groupings below are how most operations teams actually think about the obligations day-to-day.

APPs 1–5

Open & accountable handling

Have a clear privacy policy. Allow individuals to interact anonymously where reasonable. Collect personal information only when reasonably necessary. Notify individuals about collection. Apply solicited and unsolicited information rules.

APPs 6–8

Use, disclosure & cross-border

Use and disclose personal information only for the purpose it was collected for, or for related purposes the individual would reasonably expect. Direct marketing has its own rules. Cross-border disclosure carries explicit accountability for the receiving party.

APPs 10–13

Quality, security & access

Keep personal information accurate, current, and complete. Take reasonable steps to secure it from misuse, interference, loss, and unauthorised access. Allow individuals to access and correct their information. Government-related identifiers have their own constraints.

Eligible data breaches likely to result in serious harm must be assessed promptly, contained, and notified to the OAIC and affected individuals within the prescribed window. The notification is structured — what happened, what information was involved, what to do about it.

What APP entities ask before bringing AI inside the privacy boundary.

Who does the Privacy Act apply to?
The Privacy Act 1988 (Cth) applies to Australian government agencies and to private sector organisations that meet the definition of an "APP entity". Most organisations with annual turnover over A$3 million are APP entities, along with health service providers, businesses that trade in personal information, and certain other categories regardless of turnover. The Australian Privacy Principles (APPs) are the operative obligations under the Act.
What is the Notifiable Data Breaches scheme?
The NDB scheme requires APP entities to notify the OAIC and affected individuals when an "eligible data breach" occurs — that is, an unauthorised access, unauthorised disclosure, or loss of personal information that is likely to result in serious harm to one or more individuals. The entity has a statutory window to assess whether a suspected breach meets the threshold and, if it does, to make the required notifications.
Is the Privacy Act being reformed?
Yes. The Privacy Act Review final report set out a substantial reform agenda in 2022, and amending legislation has been progressing in stages. Reforms in flight include expanded individual rights, tighter rules on automated decision-making, statutory recognition of privacy intrusions, and stronger enforcement powers. Commencement dates depend on the specific provisions; check the OAIC website for the current state of the reforms.
